Judge says offenses began with violent domestic assault

NEBRASKA CITY – A district judge handed down a five-year prison sentence in Otoe County for a Lincoln man on convictions for ramming his car into an occupied police car, operating a motor vehicle to avoid arrest and domestic assault.

Justin Lobato, 41, was sentenced to three years for assault on an officer July 23.

After noting his criminal history, Judge Julie Smith said the incident began with a domestic assault in the parking lot of the Taco Bell at Nebraska City. A police pursuit included Highway 128 and spike strips at Nebraska City.

An arrest affidavit says the car driven by Lobato struck a police car after the spike strips were used. Lobato continued on flat tires into Nebraska City until he could no longer gain traction. He was taken into custody under threat of a stun gun.

He was sentenced to a consecutive year for operating a motor vehicle to avoid arrest and a consecutive year for domestic assault.

The judge ordered 18 months post release supervision.
