Judge sets jail time for prompt start to probation
Arrest warrant issued for Nebraska City man
NEBRASKA CITY – Preston Payne, 30, of Lincoln was sentenced in Otoe County Monday to 200 days in jail for misdemeanor attempted possession of burglary tools in February of 2021.
Judge Julie Smith said Payne was not suitable for probation because he has a burglary conviction on his record and the misdemeanor case involved burglary tools.
Co-defendant Alexander Janeke, 26, of Lincoln was earlier sentenced to six to 18 months in prison for possession of methamphetamine.
The judge said Payne can serve his Otoe County sentence at the same time as sentences in Lancaster County. If he earns good time, she said, he will be able to start his Lancaster County probation sentence after 100 days.
In other court action, an arrest warrant was issued for Ross Incontro, 33, of Nebraska City. The judge noted that Incontro failed to appear in court on April 11 and April 18. She set bonds in two cases at 10 percent of $10,0000.
Incontro was arrested following a July traffic stop and charged with possession of methamphetamine.
