NEBRASKA CITY – Tony Osborne, 57, was found guilty at bench trial of possession of 24 grams of meth and no drug stamp on March 2.

Osborne had argued that the state could not ensure proper custody of evidence because evidence technician Anna Idigima is charged with tampering with evidence in the custody of Nebraska State Patrol. At a pre-trial hearing, Osborne’s lawyer argued that while over 100 pounds of evidence is missing, there is no telling how evidence was tampered with and for how long.

Investigators say Idigima is accused of removing drug evidence from the facility, not tampering with it.

Otoe County Attorney Jennifer Panko-Rahe said the evidence was maintained in control of law enforcement and was properly sealed and documented.

Judge Julie Smith set a habitual criminal hearing and scheduled sentencing for March 28.
