Prosecutor files habitual criminal charges against Hutchins

NEBRASKA CITY- The Otoe County Attorney’s Office filed an information in district court Monday alleging that Travis Hutchins, 41, of Nebraska City is a habitual criminal.
County Attorney Jennifer Panko-Rahe cites a prison sentence for attempted possession in 2007 and a prison sentence for operating a motor vehicle to avoid arrest in 2011 in support of the habitual criminal charge.
Hutchins is accused of attacking a Nebraska City woman Feb. 10 despite a protection order, firing a shot and threatening another person in the home. Prosecutors say he fled after the gun malfunctioned.
At an earlier hearing in county court, Panko-Rahe said the incident is “eerily similar” to the facts of a prior case for which Hutchins is on post-conviction release. She said both cases involved allegations of entering a woman’s home and assaulting her.
The information also charges him with terrorist threats, second degree assault, use of a deadly weapon to commit a felony and violation of a protection order.
He is charged with a Class 1D felony, which carries a maximum prison sentence of 50 years. A habitual criminal enhancement would include a minimum of 10 years in prison and a maximum of 60 years.
Hutchins entered a written not guilty plea.
