Judge rules in favor of hospital's claim over pharmaceuticals agreement

NEBRASKA CITY – District Judge Julie Smith has ruled in favor of CHI Health St. Mary’s in its claim against Mosers U-Save Pharmacy.
In the case involving promissory notes and a guaranty agreement in 2020, the judge ruled that the hospital is owed $673,841 and the court recognized a 16 percent interest rate until the judgment is paid in full.
Court records say the hospital contracted with the pharmacy to dispense drugs for the hospital’s patients because the federal Public Health Services Act allows the hospital to buy pharmaceuticals at a preferred price. The lawsuit claims that the pharmacy agreed to collect amounts due from patients.
Court records say Robert Moser Jr. did not appear for the default judgment hearing in the district court on Oct. 2.
