Davis ordered to sex offender registration

NEBRASKA CITY – Don Davis, 68, of Nebraska City was sentenced Thursday to two years of probation and compliance with Nebraska’s Sex Offender Registry for misdemeanor domestic assault and attempted third degree sexual assault in January of 2023.
Special prosecutor Thomas Gross asked the court for the maximum probation term of two years saying Davis took out his anger over a financial situation on the victim.
A victim impact statement references continuing trauma.
Gross said the sentence will have an end for Davis, but he can not say, with any certainty, the same for the victim.
In passing sentence, Judge Julie Smith noted that the prosecutor and defense each request a term of probation and the victim asks for Davis to undergo therapy, which a probation term can provide.
The judge said the misdemeanor offense is subject to the sex offender registry for 15 years. Davis was also sentenced to $347 in restitution and a waivable, 90-day jail sentence.
Davis entered a plea to misdemeanor charges from what an Otoe County Sheriff’s Office affidavit described as unwanted touching stemming from a marital relationship.
The judge ordered Davis to have no contact with the victim.
Otoe County currently has 54 people on the sex offender registry.
