OMAHA, Neb. (WOWT) - Vinny Palermo, the former Omaha City Councilman involved in a public corruption scandal, has agreed to restitution.
Palermo and his legal team agreed upon a financial number with the U.S. Attorney when it comes to restitution for pleading guilty to one count of wire fraud: $10,292.
Part of the indictment alleges Palermo was provided personal and financial benefits in exchange for him taking actions as a councilman that would benefit the Latino Peace Officers Association (LPOA) and Police Athletics for Community Engagement (PACE).
This comes ahead of Palermo’s sentencing by a federal judge next week in Lincoln.
The plea deal calls for a maximum term of 21 months, but it could be less. The judge has some wiggle room, depending on other details of the pre-sentence investigation.
Palermo has been in the Saunders County Jail since last April. The judge said she didn’t trust him, or his three co-defendants, and worried they would obstruct justice or tamper with witnesses if they got out before trial.
Palermo will get credit for time served, which is a little over eight months. So, if the judge sticks with the 21-month maximum, Palermo would still have 13 months left to serve in federal prison, meaning he wouldn’t get out until a little more than a year from now.
If the judge sentences him on the lower end, it’s possible that he could be free as soon as this fall. Palermo’s attorney told our partners at 6 News that the plea agreement is “well reasoned and well thought out, and are reflections of the actual situation that exists.”
Palermo will be sentenced Tuesday, Jan. 16.
