NEBRASKA CITY – Logan Dorsey, 28, of Tecumseh was sentenced to 18 months probation Monday for possession of methamphetamine in March of 2020.

Court records say Otoe County sheriff’s deputies arrested Dorsey after searching his car, where he had been sleeping. A charge linked to what deputies suspected to be a modified grenade was dropped.

The probation sentence came over a prosecution recommendation of prison time. Otoe County Attorney Jennifer Panko-Rahe said Dorsey  “apparently has no motivation to change his behavior.”

Dorsey told Judge Julie Smith he is already enrolled in treatment for substance abuse and would abide by a probation order.

Judge Smith said Nebraska law creates a presumption of probation for class 4 felonies, which possession of meth falls under.

Dorsey’s attorney, Tim Noerrlinger, said Dorsey maintains his opposition to the legality of the search of the vehicle.

Deputies said after waking Dorsey in his car that was parked in the wash bay at a Syracuse car wash, they smelled the odor of marijuana.

Judge Smith earlier ruled that the odor of marijuana gives officers probable cause to search, even if that odor turns out to come from a legal source, such as hemp, which can be legally grown in Nebraska.
